Terms of Service
Please read the following terms carefully before using Texas RE PREP™.
Terms of Service
Last Updated: August 23, 2026
1. Acceptance of Terms
By accessing or using Texas RE PREP™ ("the Service"), you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these terms, please discontinue use immediately.
2. Service Description
Texas RE PREP™ is an online practice platform focused on the State Portion of the Texas real estate license exam — the Texas-specific law and rules section of the exam administered by Pearson VUE on behalf of the Texas Real Estate Commission (TREC). The Service provides independently authored practice questions, mock exams, AI-powered explanations, and progress tracking tools.
Important — No Affiliation. Texas RE PREP™ is an independent test-preparation service and is not affiliated with, endorsed by, sponsored by, or licensed by the Texas Real Estate Commission (TREC), Pearson VUE, or any pre-licensing school. We do not administer the exam and do not issue real estate licenses.
Not a substitute for pre-licensing education. Texas RE PREP™ does not replace TREC's required pre-licensing education. You are responsible for completing TREC's approved coursework and meeting all of TREC's other licensing requirements separately.
3. Eligibility
Minimum age — 18. The Service is intended for users who are at least 18 years old, consistent with the minimum age to hold a Texas real estate license. We do not knowingly create accounts for, or collect personal information from, anyone under 18.
By creating an account, you represent and warrant that you meet this eligibility requirement and that all information you provide is accurate.
3a. Geographic Availability
Texas RE PREP™ is operated from the United States, and its content is designed specifically around the State Portion of the Texas real estate license exam. The Service is not tailored to the licensing exams, curricula, or legal requirements of any other state or jurisdiction.
By accessing or using the Service, you represent and warrant that:
- You are at least 18 years of age;
- If you access the Service from outside the United States, you do so on your own initiative and are responsible for complying with any laws that apply to you locally; and
- You are not a person with whom U.S. persons are prohibited from transacting under U.S. economic sanctions, including but not limited to persons or jurisdictions identified by the Office of Foreign Assets Control (OFAC).
Because the Service is operated from and its data is processed in the United States, by using it you acknowledge that your information will be transferred to and processed in the United States, where data-protection laws may differ from those of your country of residence. How we handle that information is described in our Privacy Policy.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and current information during registration and to update your information as necessary. You must notify us immediately of any unauthorized use of your account.
Email verification & unverified-account deletion. Registration requires a valid email address that you must verify via the link we send you. As a data-minimization and anti-abuse measure, accounts that remain unverified are automatically and permanently deleted after seven (7) days, along with the limited information collected at signup. This also removes fake, mistyped, or abandoned signups. Verified accounts and any account with a purchase are never deleted by this process. If your account is deleted for non-verification, you are welcome to register again.
5. Educational Content Disclaimer
All practice questions, explanations, study materials, and AI-generated content are provided for exam-preparation purposes only. The Service is not a substitute for TREC's required pre-licensing education, official study materials, or accredited instruction. While we strive for accuracy:
- We do not guarantee that our content exactly mirrors the actual exam's questions, format, or difficulty. Practice and mock exams are independently authored and are not endorsed by, supplied by, or licensed from TREC or Pearson VUE.
- AI-powered explanations are generated by third-party large-language-model systems. LLM output may contain factual errors, mistakes, outdated references, or hallucinations. You are solely responsible for verifying any AI-generated content before relying on it.
- We do not guarantee, promise, or warrant that using our Service will result in passing the State Portion, passing the exam overall, obtaining a real estate license, or any other outcome. Outcomes depend on factors entirely outside our control.
- Exam content, format, scoring rules, retake policies, licensing requirements, and fees are set by TREC and Pearson VUE and are subject to change at any time without notice to us. We make commercially reasonable efforts to keep content current but cannot guarantee parity with the most recent administration.
- Score reports, weak-point analyses, and pass/fail indicators within the Service are statistical estimates based on your performance on our practice items and have no official relationship to actual exam results.
No professional advice. Nothing on the Service constitutes legal, financial, or career advice. For questions about licensing requirements, contact TREC directly.
6. Payments and Refunds
Pricing. Subject access is sold per subject. Each subject is $29.99. All purchases are in USD. Prices are displayed on the platform at the time of purchase and may change with reasonable notice for future purchases; active purchases retain the price you paid.
Access Duration. Each paid purchase grants 90 days (3 months) of access from the purchase date for the specific subject purchased. Access is not lifetime. After expiration, access to that subject's paid features is automatically revoked and you may purchase again at the then-current price to continue.
Payment Processing. All payments are processed by Stripe, Inc. We never see, store, or log your card number, expiration date, CVV, or full billing address. We retain only Stripe-issued transaction IDs, the amount paid, and the purchase date.
No Auto-Renewal. Each purchase is a single, non-recurring charge — there is no subscription, no automatic renewal, and no recurring charge. After the 90-day access period ends, you may choose to make a new purchase at the then-current price to regain access. We will never charge your card again without a fresh, voluntary checkout. If we ever introduce a subscription product in the future, we will obtain separate explicit consent and provide cancellation tools as required by California's Auto-Renewal Law (Cal. Bus. & Prof. Code § 17602) and similar laws.
Refund Policy (7-day, before any paid content is accessed). If you are unsatisfied with your purchase, you may request a full refund by emailing aiswingx.com@gmail.com from the email address on the account, subject to both conditions below:
- The request is sent within seven (7) calendar days of the purchase date shown on your Stripe receipt; and
- You have not accessed any paid content for the purchased subject. Trying the free sample questions does not affect your refund eligibility. Paid content is accessed — and the purchase becomes non-refundable — the moment you start a paid mock exam, answer any of its questions, or view your score or analysis for that attempt.
Refunds are issued to the original payment method via Stripe within 5–10 business days of approval. Free sample questions and any access provided gratis are non-refundable. Refund requests sent beyond the seven-day window, or after paid content has been accessed, will not be granted absent willful misconduct on our part.
Account activity records. We record login timestamps and IP address, purchase timestamps, mock-exam start/completion times, and the questions answered on each account, and may use this activity history to evaluate refund requests and to respond to chargebacks or payment disputes with our processor. See our Privacy Policy for how this data is collected and used. You can view your own login and activity history at any time from your Profile page.
Chargebacks. If you initiate a chargeback or dispute with your card issuer instead of contacting us first, we reserve the right to (a) suspend your account immediately, (b) revoke purchased access, and (c) charge a $25 chargeback-handling fee to recover Stripe's dispute fees. Please email us first; we will work in good faith to resolve any issue.
7. Intellectual Property
All content on the Service — including but not limited to questions, explanations, graphics, logos, software, and design — is the property of Texas RE PREP™ or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without prior written permission.
8. Acceptable Use
You agree not to:
- Share, distribute, or resell exam questions or content from the platform.
- Use automated tools (bots, scrapers) to extract content from the Service.
- Share your account credentials with others or allow multiple users to access a single account.
- Attempt to reverse-engineer, decompile, or tamper with the platform's software.
- Use the Service for any purpose that is unlawful or prohibited by these terms.
- Upload or transmit viruses, malware, or any harmful content.
9. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Texas RE PREP™, its owners, operators, employees, contractors, and affiliates (collectively, the "Texas RE PREP Parties") shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages — including but not limited to lost profits, lost data, lost time, missed deadlines, emotional distress, or reputational harm — arising from or related to:
- Your use of, inability to use, reliance on, or interpretation of the Service or any content within it.
- Any exam result, score, licensing outcome, or decision, whether made by you or any third party, even if based in whole or in part on Service content.
- Any error, inaccuracy, omission, hallucination, mistranslation, or outdated information in content — including without limitation AI-generated explanations, "weak-point" reports, mock-exam scoring, blog articles, and FAQ answers.
- Service interruptions, outages, latency, scheduled maintenance, third-party API failures (including Stripe and Google services), data loss, or technical failures of any kind.
- Unauthorized access to your account, password compromise, session hijacking, phishing, or credential stuffing — except to the extent caused by our willful misconduct or gross negligence.
- Conduct of other users, third-party links, or third-party content displayed within the Service.
- Changes to exam content, exam fees, retake policies, or other policies set by TREC, Pearson VUE, or other third parties.
Aggregate cap. The total cumulative liability of the Texas RE PREP Parties to you, in the aggregate and across all claims of any kind, shall not exceed the greater of (a) the amount you actually paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100). Multiple claims do not enlarge this cap.
Essential basis. You acknowledge that the foregoing limitations are essential elements of the bargain between you and Texas RE PREP™ and that the Service would not be provided without them. The limitations apply even if any limited remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations; in such jurisdictions, our liability is limited to the maximum extent permitted by law.
11. No Warranty
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. To the fullest extent permitted by applicable law, the Texas RE PREP Parties expressly disclaim all warranties including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, currency, non-infringement, quiet enjoyment, system integration, freedom from viruses or harmful components, and any warranties arising from course of dealing or usage of trade.
We do not warrant that: (i) the Service will meet your requirements; (ii) the Service will be uninterrupted, timely, secure, or error-free; (iii) information obtained through the Service will be accurate or reliable; (iv) defects will be corrected; (v) any specific exam or licensing outcome will result from use of the Service; or (vi) AI-generated content is accurate. Reliance on Service content is at your own risk.
12. Indemnification
You agree to defend, indemnify, and hold harmless the Texas RE PREP Parties from and against any and all third-party claims, demands, lawsuits, investigations, damages, losses, liabilities, settlements, judgments, costs, and expenses (including reasonable attorneys' fees, expert fees, and court costs) arising out of or relating to: (a) your use of or access to the Service; (b) your violation of these Terms or any applicable law; (c) your violation of any third party's rights, including intellectual-property, privacy, or publicity rights; (d) any content you submit, transmit, or upload via the Service; (e) any misrepresentation regarding your geographic location or eligibility; or (f) any decision made by you or any third party in reliance on Service content. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.
13. Account Termination
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these terms, engaged in fraudulent activity, or misused the platform. Upon termination, your access to purchased content may be revoked without refund for cause-based termination.
14. Governing Law and Dispute Resolution
These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising from these terms or the Service shall be resolved through binding arbitration in Travis County, Texas, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or participation in a class action.
15. Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, internet or power failures, government actions, pandemics, or cyberattacks.
16. Severability
If any provision of these terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
17. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or a prominent notice on the platform. Continued use of the Service after modifications are posted constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
